Hey,
We are purchasing a cabin in Kane Co., Utah. Due to mistakes and delays of the mortgage company, the property was not funded until Friday. The courthouse was in a town that was celebrating a holiday and was closed. Therefore it can not record until Monday. Both our agent and the seller's agent were fine with us taking ownership yesterday (Friday) because the money had been funded to the title company and the cabin has been insured by us since last Wednesday. However, the broker nixed the whole thing by saying there is a state law that requires us to wait until the deed records regardless of willing participants. I want to know, is there a state law requiring this, and is it not able to be waived?
